October Theme: Scary Stories

Per my previous blog entry, October 2019’s social media and blog theme is: Scary Stories. For the rest of the month I will share some real life scary legal stories that small businesses and trademark owners face on a daily basis. The good news is that all of the issues I discuss are fixable and most are even entirely avoidable…if you plan and prepare ahead of time.

Pay a little now or Pay a lot Later

You know that saying, “An ounce of prevention is worth a pound of cure?” Well, the same goes for most business related legal costs. It is almost always much less expensive to have your counsel set things up properly from the beginning than to try and fix issues as they pop up in the future. Unfortunately, I run into this issue with well-meaning business owners all the time. People think they are being fiscally sound by putting off things like registering for a trademark or filing for an entity formation until money isn’t so “tight” in the business. However, without fail, a problem arises and as a direct result of their attempts to be financially responsible, most owners wind up spending a lot more to the fix the problem than they would have if they had just taken care of the cost initially. Worse, some may even become personally liable due to their failure to act or lose the ability to register the mark they’ve earned so much goodwill towards. Thus, my goal in highlighting some of these common issues is to get people thinking about how they can prevent future expenses and problems by acting proactively and not reactively.
